INTRODUCTION

The website www.bonsens.co (hereinafter the “Site”) is an information and e-commerce website accessible via the Internet and open to any user of this network (hereinafter the “Internet User”). It is published by the company Sixty one / Sixty six (hereinafter “Bon Sens”), a limited company with share capital of €1,000 whose registered office is at 473 Rte de Tavan 74410 St Jorioz France registered with the Annecy Trade and Companies Register under number 828 409 680.

Through the Site Bon Sens offers for sale essential oils, cosmetic ingredients, cosmetic products, and food products manufactured by and or for Bon Sens (hereinafter the “Products”) to Internet Users browsing the Site (hereinafter the “Users”). The User who has validated an order is hereinafter referred to as the “Customer”. The rights and obligations of the User necessarily apply to the Customer.

Any order for a Product offered on the Site requires prior consultation and express acceptance of these general terms and conditions of sale and withdrawal as evidenced by ticking the box “I have read and accept the general terms and conditions”.

ARTICLE 1 – PURPOSE

These general terms and conditions of sale define exclusively within the scope of relations established over the Internet the rights and obligations of the Parties arising from the online sale of the Products offered on the Site.
They govern all the steps necessary to place an order and ensure the follow-up of this order between the Parties.
These terms apply to the exclusion of any other document.

ARTICLE 2 – PRODUCTS

2.1 Products

The Products offered for sale by Bon Sens are those shown on the Site on the day of the User’s visit and subject to availability.
If any Product is unavailable, the Customer will be informed as soon as possible.
The photographs and texts illustrating the Products are not contractual.

2.2 Use of the products

The Site offers for sale products intended for personal care. These products are intended for private individuals only.

Some products offered on the Site may be highly concentrated and powerful and may be dangerous if misused, notably essential oils. Bon Sens provides consumers with the information necessary for proper use of the products.

The information provided regarding essential oils does not constitute medical advice. Any therapeutic use of essential oils must be carried out under the supervision of a qualified healthcare professional.

Bon Sens cannot be held liable for damage resulting from improper use of the products sold on its Site or from failure to follow the instructions for use.

Bon Sens also offers customers DIY care recipes using ingredients available on the Site. Bon Sens reminds customers that placing cosmetic products on the market is regulated by the EU Cosmetics Regulation and the French Public Health Code. Any customer wishing to make recipes for commercial purposes must comply with these regulations.

2.3 Resale of Bon Sens and Beau Cliché products

The resale of Bon Sens and Beau Cliché products is not permitted unless there is a written contractual agreement with Sixty one / Sixty six the owner of the trademarks.
Repackaging Bon Sens or Beau Cliché products for resale under another brand is not permitted unless expressly authorized in writing by Sixty one / Sixty six.

ARTICLE 3 – PRICES

Prices are indicated in euros and apply to European Union territories excluding overseas departments and territories. They include any discounts and French VAT applicable on the order date.

Any order placed on the Site and delivered outside the European Union and to overseas departments and territories will be invoiced without VAT and may be subject to taxes, customs duties, and other related charges imposed upon arrival of the parcel at its destination. These additional costs are the Customer’s responsibility.
Prices shown on the Site are guaranteed on the order date, subject to availability and except in the event of obvious typographical error or omission.
Prices do not include shipping fees, which will be charged in addition or offered depending on the order amount and the delivery country, and will be shown to the User at final order validation.
These shipping fees do not include customs and other ancillary charges that may be requested upon entry into certain countries, which remain the sole responsibility of the Customer.
Bon Sens reserves the right, which the User accepts, to change prices at any time.

ARTICLE 4 – ORDER REGISTRATION AND VALIDATION

4.1 Browsing the Site

The User may view the various Products offered for sale by Bon Sens on the Site.
The User may browse freely through the Site pages without being committed to an order.

4.2 Placing an order

If the User wishes to place an order, they will select the Products of interest and add them to the cart by clicking the “cart” icon.
At any time the User may :

  • view a summary of selected Products by clicking the cart
  • continue or modify the selection by using the menu
  • finalize the selection and order the Products by clicking “Place order”.

To order the selected Products after clicking “Place order” each User must identify themselves by entering the email address and password chosen when creating an account, or if this is a first order by clicking “Sign up”. In the latter case, the User must accurately complete the form provided, including the information needed for identification, name, surname, postal address, and provide an email address and a personal confidential password required for future identification on the Site.
The User is informed and agrees that entering these two identifiers constitutes proof of identity and consent.
Once the User has identified the delivery address (as specified in Article 5 below), then an order summary will appear showing the nature, quantity, and price of the selected Products, the total order amount, the shipping fees, the User’s contact details, and the delivery address.

Promotional offers
To benefit from a promotional offer sent to them, the User must enter and validate their promo code in the field provided on the Order Summary page.

4.3 Final order validation and payment

After reviewing the order and once all required information has been completed, the User must choose a payment method to confirm the order.

  • Orders can be paid in euros by European or international bank card or via PayPal.

When paying by bank card, the User is automatically redirected to the payment platform’s secure server protected by SSL encryption. Payment data never passes through Bon Sens’s information systems.
Once payment is validated, the order is recorded. The User becomes the Customer. The purchase order will be stored in Bon Sens’s IT records and will serve as proof of the contractual relationship between the Parties.
In accordance with Article 6 below, the Customer has a right of withdrawal and refund for fourteen 14 working days from the date the Products are received.

4.4 Order confirmation

An order confirmation will be displayed once the order is validated.
This confirmation includes all elements of the contract concluded between the Parties.
An order summary is also sent to the Customer by email within minutes of purchase.
The Customer can then access order tracking by clicking “my account” and logging in with their email address and password.

4.5 Modifying an order

Order tracking is available under “My account” >> “Orders”.

An order can be modified or cancelled only while its status is “in progress”.
An order with status “in preparation” or “shipped” or “completed” can no longer be modified.

ARTICLE 5 – DELIVERY

5.1 Shipping times and methods

Orders are processed as quickly as possible by Customer Service and the Shipping Department Monday to Friday.
Orders are prepared upon receipt of payment. Payment by bank card ensures faster processing.

Mainland France delivery times
Shipments take place within 48 working hours after payment is received unless otherwise indicated on the cart page.
After handover to the carrier, delivery times are :

  • 3 to 5 working days by Colissimo
  • 3 to 5 working days by Chronopost Pickup Point.

Times are business days and exclude postal routing issues.

Rest of world delivery times
Orders are delivered by Colissimo or Chronopost, depending on the destination country. The countries served, shipping methods, and transit times are indicated on the Bon Sens Site.

5.2 Delay or missing delivery

Parcel lost in transit
Colissimo and Chronopost are highly reliable but delivery may be delayed or a parcel may be lost. For a delivery delay of more than 7 days, the Customer must inform Bon Sens Customer Service, which will notify Colissimo or Chronopost and open an investigation. This investigation may take up to 21 days from opening.
If the parcel is found during this period, it will be redirected immediately to the Customer’s address. If the parcel is not found after 21 days, the carrier considers it lost. In that case, Bon Sens will send a replacement parcel at its expense. If the lost products are no longer available, Bon Sens will refund the Customer the amount for those products.

Order cancellation
If delivery is more than 7 days late compared with the scheduled date, the Customer may cancel the order by contacting Bon Sens Customer Service at commande@bonsens.co.

5.3 Anomalies

Any delivery anomaly, damage open parcel, damaged parcel broken products must be noted on the delivery slip as “handwritten reservations” and signed by the Customer. The Customer must immediately report the anomaly to Bon Sens Customer Service so that a claim can be filed with Colissimo or Chronopost.
Bon Sens will resend the replacement products at its expense.

ARTICLE 6 – RETURNS AND RIGHT OF WITHDRAWAL

6.1 Withdrawal conditions

The Customer has fourteen 14 days from receipt of the complete order to withdraw without having to provide a reason.

To exercise the right of withdrawal, the Customer must notify Bon Sens of the decision to withdraw by an unambiguous written statement indicating full name, email address, postal address, order number, and order date

6.2 Refund

If the Customer withdraws Bon Sens will refund payments received from the Customer without undue delay and in any event no later than fourteen 14 days from the day Bon Sens is informed of the Customer’s decision to withdraw.
If the Customer withdraws from the entire order, Bon Sens will refund all payments received for that order.
If the Customer withdraws for only some Products, Bon Sens will refund the amount of the returned Products.
Refunds are made using the same payment method used for the order or by bank transfer.
Bon Sens may defer the refund until it has received and checked the Products.

6.3 Returning products

The Customer must return the Products no later than fourteen 14 days after communicating the withdrawal decision.
Returned products must be unopened, complete, and undamaged.

and must include on a separate sheet the following information: full name, email address, postal address, order number, and order date.
The Customer bears the cost of returning the complete order or the Products.

ARTICLE 7 – QUALITY GUARANTEE

The Customer benefits from a quality guarantee on Bon Sens products.
If a defect is confirmed, Bon Sens undertakes to exchange or refund the defective or non-conforming products as well as any return shipping costs within fourteen 14 days.

ARTICLE 8 – DATA PROTECTION

Providing personal data collected in the context of distance selling is mandatory as this data is necessary to process and deliver orders and to issue invoices. This information is strictly confidential and is not shared with third parties.
In accordance with the French Data Protection Act “Informatique et Libertés”, the processing of personal data relating to customers has been declared to the CNIL under registration number 1079702.
Under Article 34 of the law of 6 January 1978, the Customer has the right to access, modify, correct, and delete data concerning them.

ARTICLE 9 – DISPUTES

These terms are governed by French law. Bon Sens cannot be held liable for damages of any kind, whether material or immaterial or bodily resulting from misuse of the products sold.
In case of difficulty in applying these terms, the Customer may, before any legal action, seek an amicable solution with the help of a professional association, a consumer association or any advisor of their choice.
Claims or complaints will always be received with careful attention, and good faith is presumed for anyone who takes the time to explain their situation. In the event of a dispute, the Customer should first contact the company to seek an amicable solution.
Failing an amicable agreement, the dispute will be submitted to the French courts unless mandatory legal provisions provide otherwise.
